We don't know what Hegseth and Noem will recommend on April 20

There may be a report on invoking the Insurrection Act

Declaring a national emergency at the southern border of the United States

By April 20, which will be "within 90 days" of a proclamation signed on Inauguration Day, there's supposed to be an official recommendation on invoking the Insurrection Act. Those federal laws are in Title 10, Chapter 13, Sections 251–255.

The Inauguration Day proclamation said:

the Secretary of Defense [Pete Hegseth] and the Secretary of Homeland Security [Kristi Noem] shall submit a joint report to the President about the conditions at the southern border of the United States and any recommendations regarding additional actions that may be necessary to obtain complete operational control of the southern border, including whether to invoke the Insurrection Act of 1807.

On social media, you may hear speculation about whether the report will call for "martial law" and whether the policed area would extend beyond the region of "the southern border."

You may also hear attempted debunkings of these rumors on the grounds that Trump isn't "allowed" to make an extreme violent power grab, that the border is relatively quiet now so martial law isn't warranted, or that martial law is anyway not exactly what this order says.

But, of course, legal constraints are out the window after the Supreme Court gave presidents immunity last year, nor does this president intend to address real problems or stay consistent with his words and actions. In general, we are experiencing a deepening slide into authoritarianism.

In summary, we don't know what Hegseth and Noem will recommend nor how the president will implement those recommendations, but we'll soon find out. As always, it's good to keep your affairs in order and try to help others.
